POND GURU
Terms of Use
Effective Date: October 17, 2026 | Last Updated: October 17, 2026
1. Website operator and scope
These Website Terms of Use (Terms) govern the features and content of pondguru.com and any website pages that expressly link to these Terms (Website). The Website is operated by Pond Guru Franchising LLC (we, us, or our). Pond Guru Corp is the parent company and is a separate legal entity. References to the Pond Guru brand do not mean that these companies and every independently owned franchisee are the same business.
By checking a box accepting these Terms, or submitting a form that conspicuously states that submission constitutes acceptance and links to these Terms, you agree to them. Do not submit a form or use a feature requiring acceptance if you do not agree. The Privacy Policy explains information handling; it is not a substitute for any separate consent required for marketing, recording, or other activities.
2. Eligibility and authority
You must be at least 18 and legally able to enter into an agreement to request a quote or other business services through the Website. If you act for a business, homeowners association, property owner, or other organization, you represent that you are authorized to submit the inquiry and provide its information. You must provide accurate contact information and may not impersonate another person.
3. Independently operated locations
Pond Guru services may be provided by independently owned and operated franchisees. We receive inquiries centrally and may direct them to a location based on the property, requested work, and service availability. Pond Guru Franchising LLC, Pond Guru Corp, and the assigned location may participate in responding to and coordinating an inquiry, subject to applicable communication permissions.
The legal entity identified in your accepted proposal or service agreement is the business contracting with you. Use of the Pond Guru name, a shared website, or a central contact number does not by itself make Pond Guru Franchising LLC or Pond Guru Corp a party to a franchisee’s customer agreement. Nothing in these Terms eliminates any entity’s responsibility for its own conduct or any liability that applicable law imposes.
4. Inquiries, estimates, and service agreements
Submitting an inquiry, requesting a consultation, or receiving an automated acknowledgment does not book work, guarantee availability, or establish a contract for field services. Any scope, price, schedule, warranty, payment obligation, cancellation provision, or continuing maintenance obligation must be established in the applicable agreement with the service provider.
Website descriptions, preliminary recommendations, and illustrative prices are subject to property evaluation and the terms of any specific offer. Where a signed customer agreement addresses the actual services, that agreement controls over these Website Terms for those services. These Terms do not amend an existing master service agreement, proposal, statement of work, equipment agreement, or warranty.
5. No website checkout
The Website does not accept customer payments. The entity providing services issues its own invoices through a billing system separate from the Website. Its agreement, invoice terms, and applicable payment-provider terms govern those transactions. Do not submit payment card numbers, bank credentials, or other sensitive financial information through a general inquiry form.
6. Informational content and property-specific decisions
Articles, photographs, vegetation descriptions, treatment discussions, project examples, and other Website content provide general information. They are not a property-specific inspection, engineering opinion, laboratory result, regulatory approval, or instruction to apply a pesticide or perform potentially hazardous work.
Do not rely on Website content alone to select a chemical, determine a dosage, operate equipment, repair electrical systems, dredge, remove vegetation, alter a shoreline, or decide whether a permit is needed. Obtain appropriate site-specific professional guidance and follow applicable product labels, authorizations, and safety requirements. A photograph, testimonial, or past project does not guarantee the same outcome for another property. Any express commitment in your service agreement remains governed by that agreement.
7. Intellectual property
The Website design, written material, photographs, graphics, videos, logos, and other content are owned by Pond Guru Franchising LLC, Pond Guru Corp, or their respective licensors, as applicable, and are protected by intellectual property laws.
You may view the Website and retain reasonable copies for personal use or internal evaluation of Pond Guru services, preserving ownership notices. Except as permitted by law or written permission from the rights holder, you may not republish, sell, commercially exploit, or distribute Website content, or use Pond Guru marks in a way that implies an affiliation or endorsement. No ownership of our branding or content transfers to you.
8. Information and materials you submit
You retain your rights in photos, descriptions, documents, and other materials you submit. You authorize us, our parent company, the location handling your request, and supporting service providers to receive, store, copy, and use those materials as reasonably needed to evaluate and respond to your inquiry, coordinate requested services, and maintain related records, subject to the Privacy Policy and applicable law.
You represent that you have authority to provide the materials and any personal information they contain. This permission does not, by itself, grant permission to publish your identifiable photos, name, or testimonial in advertising. Any such use must have an appropriate separate authorization or other lawful basis. Nothing in these Terms prohibits an honest review or other legally protected communication.
9. Acceptable use and external services
You may not use the Website to commit fraud, harass others, submit unlawful or malicious material, obtain unauthorized access, disrupt service, bypass security controls, or extract personal information about others. Automated access that interferes with the Website or disregards applicable access restrictions is prohibited. Ordinary search-engine indexing consistent with our published instructions is permitted.
The Website may link to outside websites, social media, documents, or separate billing systems. Those services are operated under their own terms and privacy practices. Review them before providing information or completing a transaction. We may restrict access to Website features to address misuse, security concerns, or operational needs.
10. Communications and text-message terms
An inquiry requests a response about that inquiry. It does not automatically enroll you in recurring promotional messages. Marketing calls and texts that require consent will be subject to separate consent identifying the sending business and the communications authorized. Giving permission to one business does not, merely because a lead is referred, give every franchisee permission to send marketing texts.
When you separately enroll in a Pond Guru text-message program covered by these Terms, messages may concern the inquiry, estimates, scheduling, service updates, or promotions described at enrollment. Only the message categories and business identified in that enrollment are authorized. Messages may be sent using automated technology where disclosed and authorized. Message frequency varies. Message and data rates may apply. Consent to promotional texts is not a condition of purchasing services.
To stop texts, reply STOP to the sending number. You may also communicate an opt-out through another reasonable method, including info@pondguru.com. For assistance, reply HELP or email info@pondguru.com. We will honor valid revocations as required by applicable law and the messaging program. A permitted, non-promotional confirmation may follow an opt-out. A withdrawal of permission will not be bypassed by switching sending numbers or routing the same campaign through another location.
Provide a number you are authorized to use and tell the sender if you stop using it. Delivery depends on communications networks and is not guaranteed; carriers are not responsible for delayed or undelivered messages. Texting is not an emergency channel. A separately operated franchisee program may have its own identified sender and additional enrollment terms. Nothing here supplies consent for that separate program.
11. Website availability and disclaimers
To the fullest extent permitted by law, the Website and its general informational content are provided as available and without warranties of uninterrupted access, error-free operation, or suitability for a particular property or purpose. We may update content or change Website features. We do not promise that every page will always be complete, current, or free of technical errors.
This section concerns the Website. It does not replace an express service or product warranty, excuse misleading advertising, or exclude rights or obligations that cannot lawfully be excluded.
12. Limitation of website-related liability
To the fullest extent permitted by law, Pond Guru Franchising LLC, Pond Guru Corp, and their respective personnel and licensors will not be liable for indirect, incidental, special, exemplary, or consequential loss arising from use of, or inability to use, the Website, including lost profits resulting from Website interruption.
This limitation does not exclude liability for fraud, willful misconduct, gross negligence, or any liability that cannot lawfully be excluded. It does not change liability under a separate customer agreement or eliminate mandatory privacy, security, consumer-protection, or communication obligations. No service-related liability limit is created by these Website Terms.
13. Governing law and courts
These Terms are governed by Florida law, without applying conflict-of-law rules that would displace it, except where mandatory law gives you additional protection. Subject to any nonwaivable right to another forum, disputes about these Terms or use of the Website will be brought in a state or federal court of competent jurisdiction located in Miami-Dade County, Florida.
This provision does not replace dispute-resolution terms in a separate service agreement. These Website Terms do not require arbitration or contain a class-action or jury-trial waiver.
14. Changes and general provisions
We may update these Terms and will identify the effective date of the updated version. Changes apply prospectively and do not rewrite an already accepted service agreement or create new marketing consent. Where required, we will provide additional notice or obtain acceptance before applying a material change.
If a provision is unenforceable, the remainder will continue to apply to the extent permitted by law. A failure to enforce a provision is not a permanent waiver of it. These Terms and any additional terms expressly accepted for a Website feature address that feature; they do not supersede a separate service contract or override applicable legal rights.
